Critical: Appeal Deadlines Are Strict

You generally have 60 days from the date on your denial notice (plus 5 days for mailing) to file an appeal. Missing this deadline can permanently forfeit your right to appeal that decision. Contact us immediately after receiving a denial.

The Four Levels of Appeal

Reconsideration

60 days from denial

The first level of appeal. A different SSA reviewer — not the one who made the original decision — examines your entire case. We help you submit additional medical evidence and a written statement explaining why the denial was incorrect.

Note: Most reconsiderations are also denied, but this step is required before you can request a hearing.

ALJ Hearing

60 days from reconsideration denial

If reconsideration is denied, you may request a hearing before an Administrative Law Judge (ALJ). This is where many claims are ultimately approved. The ALJ reviews your case independently and may hear testimony from medical or vocational experts.

Note: ALJ hearings have the highest approval rate of any appeal level. Preparation is critical.

Appeals Council Review

60 days from ALJ decision

If the ALJ denies your claim, you can request a review by the SSA's Appeals Council. The Council may review the decision, send it back to an ALJ, or deny the request for review.

Note: The Appeals Council reviews for legal errors, not simply to re-weigh evidence.

Federal District Court

60 days from Appeals Council decision

As a final option, you may file a civil lawsuit in federal district court. This is a formal legal proceeding. At this stage, we strongly recommend consulting a licensed disability attorney.
